Terms of service

1. ACCEPTANCE OF THESE TERMS AND CONDITIONS

By using this online store (the “Store”), whether or not you actually purchase any product or service (referred to herein as a “Product” or “Products”),  you agree to be bound by the following terms and conditions (the “TCs”), including those additional terms and conditions and policies referenced or hyperlinked in this website. 

Please read these TCs carefully before accessing or using the Store. If you do not agree to these TCs, then you may not access the Store or use any services.

Each time you use the Store you accept and agree to the TCs.  

2. WHO CAN USE THE STORE

You may use the Store only if you are a resident of Canada and are at least 16 years old. 

In order to place an order on the Online Store, you must already have or will register for a user  account with the Store  (an “Account”). 

You are responsible for maintaining the confidentiality of your password to your Account,  and for having proper data security in any computer or device you use. 

3. YOUR INFORMATION

All information you provide to the Store,  including registration information, payment information (credit card numbers) must be true, accurate, current and complete. AMA will rely on the information you provide. You will be solely responsible and liable for any and all loss, damage, and additional costs that you, AMA or any other person may incur as a result of your submission of any false, incorrect or incomplete information or your failure to update or correct such incorrect information.

4. OTHER APPLICABLE POLICIES

In using the Store, you are subject to these other AMA website terms and conditions.  These include:

The platform that makes up the Store is hosted by Shopify.  By using the Store, you understand and agree that you may be subject to Shopify’s terms and conditions.  Please also be aware that Shopify will be the party accepting payments you make at Store using a payment card.  Shopify and AMA both use Stripe as the payment card processor. 

5. PRODUCT AVAILABILITY AND PRICE ERRORS

AMA works to provide current and accurate information in the Store. However, errors and omissions pertaining to Product descriptions and pricing may sometimes occur. 

AMA cannot guarantee that Product will be available when ordered at the Store or thereafter. 

AMA may at any time change the selection, availability, quantities, description and the prices and other charges of Products in the Store at any time. 

6. PRODUCT SATISFACTION

Custom made products (i.e. T-shirts with printing on demand added)  and products purchased by non AMA Members are not eligible to be exchanged, replaced or refunded.  All sales are final in such circumstances. 

If you as an AMA member receives a Product which is materially defective or has been damaged prior to shipping, you may contact us at shop@ama.ab.ca and we may provide you options, if any, to resolve your concerns

7. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

AMA does not guarantee, represent or warrant that the Store will be uninterrupted, timely, secure or error-free.

AMA does not warrant that that the product details or other content that may be viewed on the Store will be accurate or reliable.

Your use of the Store is at your sole risk. Any Products  purchased from the Store are provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

AMA, and it’s directors, officers, employees, affiliates, agents, contractors, suppliers, service providers or licensors shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Store or any Product purchased from the Store, or for any other claim related in any way to your use of the Store or the purchasing of a Product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Store or any content (or product) posted, transmitted, or otherwise made available via the Store, even if you have been advised of their possibility. 

The Store may have links to websites or other online platforms operated by third parties. If you enter any third party site or property, you should review their terms of use and be comfortable with their privacy and security policies. We do not guarantee and are not responsible for the privacy or security of any third party sites, including the accuracy, completeness, or reliability of information found on these sites. 

Our inclusion of links to other sites, by itself, imply any endorsement of the content on such platforms or of their owners or operators,

8. RISK OF LOSS

Risk of loss and title for items purchased from the Store pass to you when it is given to the carrier to ship your purchase to you.  

9. SHOPIFY USE OF INFORMATION 

Shopify collects and processes personal information about your access to and use of the Store in order to provide and improve the online shopping experience of the Store. Information you submit to the Store will be transmitted to and shared with AMA and Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. 

Shopify may use enhanced features that incorporate data and information obtained from user interactions with the Store, along with other merchants. 

To provide these enhanced features, Shopify may make use of personal information collected about users of the Store along with other merchants. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes.

10. TERMINATION

The TCs are effective unless and until terminated by either you or us. You may terminate these TCs when you cease using the Store.  Likewise, should you use the Store, you agree to these TCs

AMA may terminate your use of the Store at any time should you fail, or we suspect that you have failed, to comply with any term or provision of these TCs or other policies issued by AMA.  Termination will occur when AMA disables your account in the Store, which can happen with or without advance notice. 

11. GOVERNING LAW

These TCs and any separate agreements regarding the purchase of products from the Store shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to the conflict of laws principles thereof. Any legal dispute arising from your use of the Store in any manner shall be addressed through the courts located in the judicial centre of Edmonton, Alberta

12.  OTHER MATTERS

If any provision of these TCs are held to be invalid or unenforceable for any reason, then the provision will be deemed to be severed from these TCs and the remaining provisions will continue in full force and effect. 

Neither AMA or you may assign its rights and obligations under these TCs.
